Terms and Conditions
1. General
PanelsAndSwitches.com (“we,” “us,” “our”) operates as a supplier and coordinator of medium-voltage electrical equipment, including but not limited to switchgear, switchboards, MCCs, transformers, and related components. All sales and quotes are subject to the following Terms and Conditions.
By issuing a purchase order, submitting a deposit, or otherwise authorizing a transaction, the customer (“Buyer”) agrees to these Terms and Conditions in full.
2. Custom Orders / Non-Refundable Policy
The majority of products sold by PanelsAndSwitches.com are custom-built to order.
Once an order has been placed — whether through a signed purchase order, electronic confirmation, or deposit payment — the order becomes non-cancelable, non-returnable, and non-refundable.
Production begins immediately upon receipt of the purchase order or deposit, and materials, components, and labor are committed at that time.
3. Order Accuracy and Buyer Responsibility
The Buyer is solely responsible for ensuring that the equipment, specifications, and configurations requested are suitable for their intended use and application.
PanelsAndSwitches.com provides equipment and assemblies based on the information supplied by the Buyer and is not responsible for design suitability, compliance with site conditions, or local code requirements.
PanelsAndSwitches.com does not provide engineering services or field verification unless explicitly stated in writing.
By proceeding with a purchase, the Buyer acknowledges and accepts full responsibility for confirming all ratings, dimensions, voltages, amperages, and configurations prior to order placement.
4. Build Times and Delivery
All quoted lead times and build times are estimates and subject to change due to factors such as material availability, manufacturing capacity, vendor delays, shipping logistics, weather, or force majeure events.
PanelsAndSwitches.com will make reasonable efforts to meet quoted timeframes but shall not be held liable for any delays or consequential losses resulting from delayed delivery or extended build times.
Rush builds and expedited timelines are offered as a service but are not guaranteed.
5. Payment Terms
Orders may require full payment upfront or a non-refundable deposit before production begins.
Remaining balances are due upon completion of the build and prior to shipment unless otherwise noted on the quote or invoice.
Late payments may delay shipment or result in storage fees.
6. Shipping and Risk of Loss
Unless otherwise specified, shipments are made F.O.B. origin (factory or vendor warehouse).
Title and risk of loss transfer to the Buyer upon shipment.
Any shipping damage must be reported directly to the carrier.
7. Limitation of Liability
PanelsAndSwitches.com’s total liability, whether in contract, warranty, or otherwise, shall not exceed the purchase price of the product.
Under no circumstances shall PanelsAndSwitches.com be liable for indirect, incidental, or consequential damages, including but not limited to loss of profits, downtime, or labor costs.
8. Force Majeure
We shall not be liable for failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to supply-chain interruptions, natural disasters, acts of God, labor disputes, or government actions.
9. Governing Law
All transactions shall be governed by and construed in accordance with the laws of the State of Colorado, without regard to its conflict-of-law principles. Any disputes shall be resolved in the courts of Denver County, Colorado.
Limited Warranty
1. Scope
PanelsAndSwitches.com warrants that products sold as new or refurbished are free from material defects in workmanship and components at the time of delivery.
New equipment: Covered under the original manufacturer’s warranty, if applicable.
Refurbished or reconditioned equipment: Covered by PanelsAndSwitches.com for a period of 12 months from the date of shipment unless otherwise specified.
2. Exclusions
This warranty does not cover:
Misuse, improper installation, or operation outside of rated parameters
Damage from short circuits, voltage spikes, or environmental factors
Alteration, modification, or repair by unauthorized parties
Normal wear and tear
3. Remedies
PanelsAndSwitches.com’s sole obligation under this warranty is, at its discretion, to repair, replace, or refund the defective item upon return inspection and verification.
Shipping costs and removal/reinstallation labor are not covered.
4. Disclaimer
Except as expressly stated above, PanelsAndSwitches.com disclaims all other warranties, express or implied, including but not limited to implied warranties of merchantability or fitness for a particular purpose.
